1. Acceptance of Terms

Welcome to Lamb Babies. These Terms of Service ("Terms") are an agreement between you and Lamb Babies LLC ("Lamb Babies," "Company," "we," "our," or "us"). They govern your access to and use of lambbabies.com (the "Website") and your purchase of products through it (the "Products").

By accessing, browsing, or using our Website, or by clicking "I Agree" or completing a purchase, you agree to be bound by these Terms. You also agree to our Privacy Policy, Cookie Policy, Shipping Policy, and Return Policy, which are part of these Terms.

PLEASE READ SECTION 14 CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED THROUGH INDIVIDUAL ARBITRATION AND INCLUDES A CLASS ACTION WAIVER, UNLESS YOU OPT OUT.

If you do not agree, you must not use our Website.

 

2. Eligibility

You must be at least 18 years old to create an account or make purchases on our Website. Our Website is intended for adult parents, caregivers, and gift-givers. It is not directed to children under 13, and children under 13 may not use it. Users between 13 and 17 may browse the Website only with the involvement of a parent or guardian.

 

3. Products and Orders

A. Product Information

We make reasonable efforts to ensure that product descriptions, pricing, images, and availability are accurate. Colors and sizes may look slightly different depending on your screen. Errors may occur, and we reserve the right to do the following, even after an order has been submitted:

  • Correct errors
  • Update information
  • Cancel orders, including orders affected by a pricing or description error
  • Refuse service

If we cancel an order after you have been charged, we will refund the full amount.

B. Order Acceptance

Your order is an offer to purchase. We accept your order when it ships, not when you receive an order confirmation email. We may accept or reject any order for any lawful reason. We may also limit quantities per customer, household, or order, and decline orders that appear to be placed by resellers.

C. Pricing and Taxes

All prices are listed in U.S. dollars. Applicable sales tax and shipping charges are shown at checkout before you place your order. Prices may change at any time, but changes will not affect orders we have already accepted.

D. Promotions and Discount Codes

Unless stated otherwise:

  • Only one promotion or discount code may be used per order.
  • Codes have no cash value, cannot be applied to past orders, and may not be combined with other offers.
  • We may modify or end a promotion at any time, and we may cancel orders that misuse a promotion.

Any additional terms will be shown with the offer.

 

4. Payments

Payments are processed securely through third-party payment providers. By submitting payment information, you represent and warrant that:

  • You are authorized to use the payment method; and
  • The billing information you provide is accurate.

You authorize us to charge your payment method for the total amount of your order, including taxes and shipping.

 

5. Shipping and Delivery

Orders are fulfilled on our behalf by Amazon through Amazon Multi-Channel Fulfillment, as described in our Shipping Policy. Shipping times are estimates and are not guaranteed. Title to the Products and risk of loss pass to you when the Products are delivered to the shipping address you provided.

We are not responsible for delays caused by carriers, weather, or other events beyond our reasonable control. Lost or damaged packages are handled as described in our Shipping Policy.

 

6. Returns and Refunds

Returns are governed by our Return Policy. Certain products cannot be returned, including opened items that go in or near a baby's mouth, opened personal-care products, final-sale and clearance items, and gift cards. Approved refunds are issued to the original form of payment.

 

7. Accounts

If you create an account, you agree to:

  • Provide accurate information and keep it up to date
  • Keep your login credentials confidential
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

 

8. Intellectual Property

All Website content, including logos, product designs, images, graphics, text, layout, and branding, is the property of Lamb Babies or its licensors. It is protected by U.S. and international intellectual property laws.

We grant you a limited, personal, non-transferable license to use the Website to shop for Products. No content may be copied, reproduced, distributed, displayed, or used for commercial purposes without our prior written consent.

 

9. Product Use, Safety & Assumption of Risk

We care deeply about your baby's well-being. Please read and follow all instructions, warnings, and age and weight recommendations that come with each Product or appear on the product page. Keep them for future reference.

By purchasing or using our Products, you agree to:

  • Supervise children whenever they use our Products, as directed in the product instructions
  • Assemble Products correctly and inspect them before each use
  • Stop using a Product right away if it is damaged, worn, or broken, or has loose parts, and contact us
  • Not alter or modify any Product

To the extent permitted by law, we are not liable for injuries, damages, or losses caused by misuse, improper assembly, alteration, lack of supervision, failure to follow instructions or warnings, use outside the intended purpose or age range, or normal wear and tear.

Recalls. If a Product is subject to a safety recall, we will post the information on our Website and contact affected customers when we can. You can also find recall information at www.cpsc.gov.

California Proposition 65. Where required, we provide Proposition 65 warnings on product pages and/or packaging.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

 

10. Our Product Promise and Disclaimer of Warranties

We stand behind our Products. If a Product arrives damaged or has a manufacturing defect, we will replace it or refund it as described in our Return Policy. This promise is in addition to any rights you have under applicable law, and to any manufacturer's warranty included with a Product.

Except as stated above, and to the fullest extent permitted by law, the Website and Products are provided "as is" and "as available." We disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. If an implied warranty cannot be disclaimed, it is limited to the shortest period permitted by law. Some states, including California, do not allow certain warranty disclaimers, so some of these limits may not apply to you.

 

11. Limitation of Liability

To the maximum extent permitted by law:

  • Lamb Babies will not be liable for any indirect, incidental, consequential, punitive, or special damages.
  • Our total liability for any claim relating to a Product or these Terms will not exceed the amount you paid for the Product that gave rise to the claim.

These limitations apply regardless of the legal theory asserted. They do not apply to liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Some states, including California, do not allow certain limitations, so parts of this section may not apply to you.

 

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Lamb Babies and its officers, employees, affiliates, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or third-party right
  • Content you submit to the Website
  • Your misuse of the Website or Products

 

13. User Content and Reviews

If you submit reviews, photos, comments, or other content ("User Content"):

  • You grant Lamb Babies a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, and share your User Content in connection with our business, including in marketing. Where appropriate, we will credit you by first name or username.
  • You confirm that your User Content is truthful and based on your own experience. It must not violate any law or third-party right, and it must not include personal information about others, such as a child's full name or photos of other people's children.
  • If you received anything of value in exchange for a review, such as a free product or discount, you must say so in the review.

We do not remove or suppress reviews because they are negative. We may remove User Content that violates these Terms, is fraudulent, off-topic, or offensive, or contains personal information.

 

14. Mandatory Arbitration & Dispute Resolution

PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR RIGHTS.

Informal resolution. Before starting arbitration, you agree to email help@lambbabies.com with your name, order number (if any), a description of the dispute, and the relief you seek. Please allow us 30 days to try to resolve it informally. We will do the same before starting arbitration against you.

Agreement to arbitrate. You and Lamb Babies agree that any dispute arising out of or relating to these Terms, the Website, or any Product purchased or used will be resolved by binding individual arbitration under the Federal Arbitration Act (FAA), except as stated below.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Either party may also seek court relief for infringement or misuse of intellectual property. Nothing in this section prevents you from seeking public injunctive relief in court where a waiver of that right is unenforceable under applicable law.

Arbitration rules. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Fees will be allocated as provided in those rules. The arbitration will take place in Los Angeles County, California, or in the county where you live if you choose. It may be conducted by phone, by video, or through written submissions. The arbitrator's decision is final and binding.

Class action waiver. You and Lamb Babies may bring claims against each other only on an individual basis, not as a plaintiff or class member in any class, collective, or representative action, including a private attorney general action. The arbitrator may not combine claims or award class-wide relief.

Jury trial waiver. If any dispute proceeds in court instead of arbitration, both parties waive the right to a jury trial, to the extent permitted by law.

Opt-out right. You may opt out of this arbitration agreement within 30 days after you first accept these Terms. To opt out, email help@lambbabies.com with the subject "Arbitration Opt-Out" and include your name, email address, and order number (if any). Opting out does not affect any other part of these Terms.

Severability. If the class action waiver is found unenforceable for any claim, that claim will proceed in court and not in arbitration.

 

15. Privacy

Your use of the Website is also governed by our Privacy Policy and Cookie Policy.

 

16. Electronic Communications

By using the Website or placing an order, you agree to receive communications from us electronically, such as order confirmations and notices. These communications satisfy any legal requirement that they be in writing. Marketing emails are sent only if you sign up for them, and you may unsubscribe at any time.

 

17. Third-Party Services

Our Website uses third-party services, such as our e-commerce platform (Shopify), payment processors, our returns provider (ReturnGO), and Amazon Multi-Channel Fulfillment. Their own terms may also apply. We are not responsible for third-party websites that our Website links to.

 

18. Governing Law

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules. Any court proceedings permitted under these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California.

 

19. Force Majeure

We are not liable for delays or failures to perform caused by events beyond our reasonable control. These include natural disasters, pandemics, supply chain disruptions, fulfillment-center or carrier disruptions, and governmental actions.

 

20. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

 

21. Assignment

We may assign or transfer these Terms without notice. You may not assign your rights without our written consent.

 

22. Entire Agreement and Waiver

These Terms, together with our Privacy Policy, Cookie Policy, Shipping Policy, and Return Policy, are the entire agreement between you and Lamb Babies regarding your use of the Website. They supersede all prior agreements, representations, and understandings on this subject, whether written or oral.

If we waive a breach of these Terms, that waiver does not apply to any later breach. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

 

23. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page. Changes apply to orders placed and Website use after they are posted. Continued use of the Website after that means you accept the revised Terms.
